AMPS in the Air

Following the Ontario Government’s announcement regarding the implementation of administrative monetary penalties (AMPS) for illegal land uses for municipalities, a ​​Staff report is also set to come forward to the June 23 Council Meeting regarding Caledon’s enforcement of AMPS.

At the June 2 General Committee meeting, it was approved on consent that Staff will create a report respecting the amendment of various Town by-laws to permit the imposition of AMPS and fees in accordance with the Town’s AMPS By-law.

The report stated that in October 2024, Council approved and enacted the “AMPS By-law.”

Now, they are hoping to make a series of amendments to existing Town by-laws so that the Town can begin using the AMPS system already in place to enforce them.

In the report, it was stated that, to implement those penalties and, for clarity of interpretation and enforcement options, amendments are required to certain by-laws to include a provision specifically establishing the AMPS penalty for contraventions of those by-laws.

The purpose of the amendments is to implement the AMPS system already approved by Council, and the amendments do not in any way alter the substance or subject matter of the respective by-laws. 

Regarding the proposed legislative changes to the Planning Act under the Protecting Ontario’s Streets and Communities Act, 2026, that would enable municipalities to use the AMP system for zoning by-law contraventions related to land uses that are not permitted, the government is now seeking public feedback.

Until June 25, comments can be submitted to the Environmental Registry of Ontario for Bill 119.
